ABOUT THE UGC CLIQUE
The UGC Clique is an online platform that connects UGC creators with brands looking for content creators. Creators can create a profile, showcase their work and become discoverable to brands. Brands can browse creator profiles and contact creators directly.
By using The UGC Clique, creating an account or purchasing a membership, you agree to these Terms & Conditions.
CREATOR ACCOUNTS
To create and maintain a creator profile on The UGC Clique, you must create a creator account.
You are responsible for providing accurate and up-to-date information and for keeping your login credentials secure.
You may not create an account using false information, impersonate another person or use the platform for fraudulent, unlawful or misleading purposes.
You are responsible for all activity that takes place through your account.
CREATOR MEMBERSHIP
Creator access to The UGC Clique is offered through a paid subscription.
The current Creator Membership costs €9.99 per month, unless another price is clearly displayed at the time of purchase.
The membership gives creators access to features such as creating and maintaining a public creator profile, showcasing their work and being discoverable by brands through the Creator Marketplace.
Membership features may be updated or expanded as the platform develops.
PAYMENT
Creator memberships are billed on a recurring monthly basis.
Payments are processed securely through Stripe or another payment provider made available by The UGC Clique.
By purchasing a membership, you authorize the applicable payment provider to charge the membership fee using your selected payment method on a recurring basis until the subscription is cancelled.
The UGC Clique does not directly store your full payment card details.
AUTOMATIC RENEWAL
Your Creator Membership automatically renews each month unless you cancel it before the next billing date.
By starting a subscription, you agree that recurring payments may be collected automatically until cancellation.
CANCELLATION
You may cancel your Creator Membership through the membership management section of your creator account.
Cancellation stops future recurring charges. Unless otherwise stated or required by applicable law, amounts already paid for the current billing period are not automatically refunded.
After cancellation, access to paid creator features may continue until the end of the current paid billing period.
CREATOR PROFILES
Creator profiles are intended to help brands discover creators through The UGC Clique.
Information you add to your creator profile may be publicly visible. This may include your display name, profile image, location, bio, niches, content types, platforms, languages, audience information, portfolio content and social media links.
You are responsible for ensuring that all information displayed on your profile is accurate and that you have the right to upload, publish and share the content you provide.
CREATOR MARKETPLACE
The Creator Marketplace allows brands and other visitors to discover creator profiles.
Brands may browse creator profiles without purchasing a Creator Membership.
The UGC Clique does not guarantee that a creator will receive profile views, enquiries, collaborations, paid work or any specific level of exposure through the platform.
CONTACT BETWEEN BRANDS AND CREATORS
Brands may contact creators using the contact options provided through creator profiles.
Once a brand and creator communicate or enter into a collaboration, they are responsible for agreeing between themselves on the scope of work, deliverables, deadlines, pricing, payment terms, usage rights and any other conditions of their collaboration.
Unless explicitly stated otherwise, The UGC Clique is not a party to agreements made between creators and brands.
COLLABORATIONS AND PAYMENTS BETWEEN USERS
The UGC Clique does not currently process or manage payments between brands and creators for creator collaborations.
Creators and brands are responsible for arranging collaboration payments directly between themselves.
The UGC Clique is not responsible for unpaid invoices, late payments, disagreements, cancelled collaborations, non-delivery of content or other disputes arising between creators and brands.
CONTENT AND PORTFOLIO MATERIAL
Creators may upload or link content including photographs, videos, portfolio material, social media profiles and other creative work.
You retain ownership of content that you own.
By uploading content to The UGC Clique, you grant The UGC Clique permission to display that content on your profile and elsewhere within the platform where reasonably necessary to operate and promote the service.
You confirm that you have the necessary rights and permissions to upload and display any content you submit.
You may not upload content that infringes another person's copyright, trademark, privacy, intellectual property or other legal rights.
ACCEPTABLE USE
You may not use The UGC Clique to:
Provide false or intentionally misleading information.
Impersonate another person or business.
Upload content you do not have permission to use.
Harass, threaten or abuse other users.
Distribute spam, malware or harmful content.
Attempt to gain unauthorized access to accounts or systems.
Scrape, copy or systematically collect platform data without permission.
Use the platform for fraudulent or unlawful activities.
Interfere with the security or normal operation of the platform.
The UGC Clique may restrict, suspend or terminate access where these rules are violated.
ACCOUNT SUSPENSION OR TERMINATION
The UGC Clique reserves the right to suspend, restrict or terminate an account where there is reasonable evidence of misuse, fraud, unlawful activity, violation of these Terms or behavior that may harm the platform or its users.
Where reasonably possible, we may contact the account holder before taking action.
AVAILABILITY OF THE PLATFORM
We aim to keep The UGC Clique available and functioning reliably.
However, we cannot guarantee that the website or platform will always be available without interruption, errors or technical issues.
We may temporarily suspend or restrict parts of the platform for maintenance, updates, security improvements or technical reasons.
THIRD-PARTY SERVICES
The UGC Clique uses third-party services to operate parts of the platform, including services for hosting, authentication, database functionality and payment processing.
These third-party services may have their own terms, privacy policies and availability conditions.
The UGC Clique cannot guarantee uninterrupted availability of third-party services.
INTELLECTUAL PROPERTY
The UGC Clique name, branding, website design, platform structure, original text, graphics and other materials created specifically for The UGC Clique are owned by or licensed to The UGC Clique unless otherwise stated.
You may not copy, reproduce, distribute or commercially exploit these materials without permission.
Content uploaded by creators remains subject to the ownership rights of the respective creator or rights holder.
LIABILITY
To the extent permitted by applicable law, The UGC Clique is not responsible for losses resulting from agreements, communications, collaborations, payments or disputes between creators and brands.
The UGC Clique does not guarantee that creators will receive collaborations, income, exposure or business opportunities through the platform.
Nothing in these Terms excludes or limits liability where it cannot legally be excluded or limited.
PRIVACY
Your use of The UGC Clique is also subject to our Privacy Policy.
Our Privacy Policy explains how personal information is collected, used, stored and protected when you use the platform.
CHANGES TO THE PLATFORM
The UGC Clique may update, improve, remove or introduce platform features as the service develops.
We may also change membership features or pricing. Where changes materially affect an existing paid subscription, we will provide appropriate notice where required by applicable law.
CHANGES TO THESE TERMS
We may update these Terms & Conditions when our platform, services, pricing or legal obligations change.
The latest version will be published on this page together with the applicable "Last updated" date.
Where required, we may notify users of material changes.
GOVERNING LAW
These Terms & Conditions are governed by the laws of the Netherlands.
Nothing in these Terms affects any mandatory consumer rights or other legal rights that apply to you under applicable law.
